Enshrouding the grave & Women visitin qabarastaan

Question.

Is it permissible to enshroud qabr with chaadar?

Is it permissible for woman to visit the qabarastaan?

Answer.

It should be known that when it comes to any aspect of Shariah, weather it be worshiping Allah or anything, we cannot use our puny logic or adopt any haphazard way of going about it. We have to abide by the laws laid by Shariah (Allah and his messenger “Sallallaahu Alaihi Wa Sallam”). Allah mentions in the holy Qur’aan;

Translation; I did not create jinn and mankind except for my worship.

Allah Ta’âla has sent his Messenger (Sallallaahu Alaihi Wa Sallam) to teach us how we should go about worshiping Allah, and ask from Him our needs and also taught us what we are allowed to do and what we have to refrain from.

Therefore to consider anyone else to be equal to Allah in regard to His Being, Qualities, etc is shirk. And to do such things that which was not done by our Prophet (Sallallaahu Alaihi Wa Sallam), Sahaabah (Radiyallâhu An hum) and Taabieen (Rahmatullahi Alaihim) and to consider it to be part of deen is an innovation (bid’ at) and a great sin.

Imam Bukhari and Muslim (Rahmatullahi Alaihimaa) made mention in their Sahih narrated with the authority of Hazrat Aisha (Radiyallâhu A’nha) that Rasulullâh sallallâhu alaihi wasallam mentioned that, the person who innovates anything in our religion which does not have any connection with it is rejected (it will not be accepted and not considered to be a part of deen).

Therefore if one does such an act (which has no connection with Dîn) then he will be considered as though he is opposing Allah, because Shariah is something that originated from Allah, no one has the right of adding or decreasing anything, therefore that person who innovates anything in it is as though he is considering the Shariah to be incomplete, and this is a very great crime.

Briefly an innovator is opposing Allah and he is claiming equality with him, which in turn is a great sin and deviated act, even though outwardly he is worshiping Allah.

Since he is considering it to be an act of worship therefore he will not have the opportunity of making tawbah also. Therefore we should not be deceived from such act.

Enshroud the grave:

As far as the chaadar is concerned, it is such a chaadar, which she received from a grave. In Islam there is no such thing as placing chadars over a grave, so how can such a chaadar be made into an object of veneration and worship?

Hazrat Aisha (Radiyallâhu A’nha) mentioned in a hadith, which is in Muslim Shareef that, Allah Ta’aala did not command us to enshroud stone, brick and sand.

In this hadith we are being told that not to enshroud stone, wall etc, wherein apparently there is no doubt of shirk etc, therefore to enshroud Qabr with chaadr in which there is a doubt of shirk and is an act of showing veneration to someone other than Allah Ta'aala, will not be permissible to a greater extent.

How can the act of enshrouding a grave be termed as worship!!!!

To enshroud the grave will be either showing respect to the person in the grave or worshipping him. Both these acts are most definitely not permitted in Islam.

Only those things will be considered as the act of worship that which Allah Ta’aala and Rasulullâh sallallâhu alaihi wasallam have told us and commanded us to do.

By one considering the act of enshrouding the grave as worship will mean that he is changing the meaning of worship (may Allah Ta’aala save us).

Once it is known that there is no basis in Shariah in enshrouding a grave, then all those things related to it will not be permissible and will be considered as bida’t as well.  E.g. to take blessing from it, to give it to people as tabarruk and waseelah, to make dua under it and claim its acceptance etc.

women visiting qabarastaan:

As far as the visiting of the qabr is concerned, it is prohibited for women to do so, especially in today's time, it is aggravated even more due to the intermingling of different sexes that is generally the case in these types of functions.

Then how will one be blessed and gain proximity to almighty Allah.

The permissibility of visiting the graveyard is for remembrance of death by which a person will stay away from the disobedience of Allah Ta’aala thereby gaining proximity unto him.

If one wishes to make dua for the person in the grave then this can be done at anytime and anyplace where one is allowed to make dua, not necessarily by the grave only, because dua is asked from Allah Ta’aala only and Allah Ta’aala is omni-present and sees everything. However to ask from the person in the grave is an act of shirk and totally haram in Islam.

 conclusion

The conclusion is that all these acts are baseless in Shariah and it may lead one to kufr and shirk, therefore we should abstain from it and prevent others from it by using the word of wisdom (hikmat).

We ask Allah Ta’aala to save us and guide us at every step of our life.

And Allah Ta'aala Knows Best.

Who is a martyr (Shaheed)

Question.

what is the status of such a person who is killed by robbers in his house or on the road, will he be classified as a shaheed ? Is the laws of shaheed applied to him ?

Answers.

In Shari’ah there are few conditions for a person to be classified as a shaheed. If all these conditions are found then only will he be considered to be a shaheed in this world and in the hereafter. And in some cases he will only be considered as a shaheed in the hereafter (not in this world), i.e. when some of the conditions are not found.

The conditions of a shaheed are as follows:
- He must be a Muslim.
- He must be mature (baaligh) and sane.
- He must not be impure (state of hadath-e-akbar).
- He should be killed oppressively and unjustly.
- He should be killed by Kuffar (non muslims), highway robbers etc irrespective of the weapon employed thereof, however if he is killed by a muslim or a zimmi (non muslim living in an Islamic country) then it is subject to the condition that the weapon employed for the implementation of his murder should be such that it is designed to kill. E.g. guns, swords, knives, etc.
Hence if a Muslim killed him with an object such as a stone then the laws of a shaheed will not be applicable to him in this world.
  - Irti-thaath should not be found. i.e. that a person should not derive any worldly
benefit in any form whether by eating, drinking, sleeping, or by being accorded any medical treatments even thought it might be very minimal. Other conditions are that one salaah time should not elapse in a state of consciousness from the time of his injury up to the time of his death; neither should he be removed from the battlefield while conscious.

Therefore the answer to your question is that if a muslim who is mature, sane and not in the state of hadath-e-akbar is oppressively killed by robbers etc in his house etc, together with this condition that Irti-thaath is not established then he will be considered to be a shaheed and the laws of shahaadat will also applicable to him, hence ghusl will not be given to him and he will be buried together with his very blood stained clothing in which he was made shaheed. However if he had such garments on him which do not conform to the masnoon kafn then that should be removed, (i.e. jacket. Coat etc) and if there is any shortage to the masnoon kafn i.e. his body is not fully covered etc then that will be completed. If any of the above conditions is not found then he will be considered as a shaheed in the hereafter only, hence ghusl will be given to him and he will be buried in normal kafn.

difference between "Ya Ayyuhannass" and "Ya Ayyuhallazeena Aamanou"

Question.

Is there any difference between Ya Ayyuhannass"(يا أيها الناس) and  "Ya Ayyuhallazeena Aamanou"(يا أيها الذين آمنوا) ?

Answer.

Yes, in Makki Surahs generally the word " Ya Ayyuhannass"(يا أيها الناس) and in Madani Surah the words "Ya Ayyuhallazeena Aamanou"(يا أيها الذين آمنوا) is mentioned. The Mufassereen have made mention that one of the reason is that in Makkah at that particular time disbelief (kufr) was predominant, so Allah Ta'aala was calling them towards Imaan that is why they were being addressed by "Oh! People" Whereas in Madinah most of the people were believers so Allah Ta'aala was addressing them with the laws (Ahkaam) of Islam by calling them "Oh people who have brought Imaan".

Abu Huairaira's name

Question.

What was Abu Huraira's name prior to Islam ?

Answer.

According to most of the narrations which we have seen, in the times of ignorance Hadhrat Abu Hurairah's name was Abdush-shams and according to other narrations his name was Abdu-a'mr.

It should be known that in the Arabic language to differentiate between the name A'mr (عمرو) and Umar (عمر) the letter ( و) is added after the letter ( راء) in A'mr, hence it will only be in written form but not read. Therefore it will not be pronounced as Amroo, umroo, etc.

Besides these two there were some other names as well but these two are more famous.

Salaah in the plane

Questions.

(1) Can salaah be read in the plane?

(2) Will qiyaam (standing position) be farz or can it be read whilst seated ?

Answers.

If the plane is stationary then according to all the Fuqahaa (Islamic Jurists) it is permissible to read salaah in it whilst standing due to the fact that sajdah will be performed whilst the plane is touching the ground. If a person is incapacitated (ma'zoor) then he will be allowed to perform his salaah whilst seated on the plane seat.

However if the plane is flying then due to the fact that sajdah will not take place on the ground the Fuqahaa have given permissibility if the following condition is found:-

-If by him waiting for the plane to land, the time of salaah will have elapsed, with the result that he will not have the opportunity of reading the Salaah on its fixed time.
Hence, if he knows that he will still have time to read his salaah after the plane lands, then he should not read the salaah whilst the plane is in the air, but wait for it to land.

N.B. Salaah that is performed in the plane should be in a standing position unless someone is incapacitated (ma'zoor i.e. excuses like dizziness, no authorization from the plane officials to stand or no place etc).

To rub the body with Zamzam water

Question.

Is it permissible to rub Zamzam water on the body?

Answer.

It is permissible to rub Zamzam water over the body provided that there is no impurity (najaasat) thereon. According to our Fuqahaa it is permissible to even take a normal bath (i.e. not a Waajib bath of Janaabat) with Zamzam water as long as it is not used to remove impurity from the body

From this we deduce that to rub Zamzam water on the rear and front part of the body is permissible provided that the objective is not to remove najaasat (impurity) but rather just for treatment.

Selling of items which is not in one's possession.

Question.

can a person sell an item which is not in his possession at the time of sale?

Answer.

It is not permissible to sell goods that haven’t come into one’s physical possession. However those things which are immovable i.e. land, house, garden, farm, well etc there is no need for a physical possession to take place due to the fact that it is very rare for immovable assets to be destroyed in a short term, therefore they will enter into the constructive possession and the liability of the buyer by merely purchasing them.

As for movable items i.e. goods, cars, furniture etc they will not enter into the liability of a person by merely purchasing them, therefore it necessitates physical possession since there is a possibility of them being destroyed before delivery takes place.

Thus if anyone sells a movable item which is not in his possession as yet then this transaction is cancelled due to the fact that if that item happens to get destroyed then the first transaction is void. Once the first transaction is void (because of the destruction that occurred in the item of the first transaction) then the second transaction will automatically be cancelled since it is based on the first transaction.
